Distance Contract

Distance Contract

By placing an order in the online store ZIMOGUVEIKALS.LV, you confirm that you have read and accepted the terms of this Distance Contract.

This Distance Contract is concluded between SIA “Zīmogu darbnīca” (registration No. 40103254713), the owner of the online store www.zimoguveikals.lv (hereinafter – the Seller), and the buyer who places an order (hereinafter – the Buyer).

Seller contact details:
Address: Riga, Matisa iela 78A, Latvia
E-mail: info@zimoguveikals.lv

Note: “Consumer” means a natural person purchasing goods/services for purposes not related to business or professional activity.

1. Placing an order and concluding the contract

1.1. The Buyer places an order in the online store by completing the required fields and clicking the “Order” button.

1.2. The Buyer’s order constitutes an offer to conclude this Distance Contract. The contract is deemed concluded when the Buyer receives the Seller’s order confirmation on a durable medium (e.g., by e-mail).

2. Prices and payment

2.1. Product/service prices are displayed in the online store. VAT is applied in accordance with applicable legislation (if applicable). Delivery costs are shown during checkout and/or in the invoice.

2.2. Before fulfilling the order, the Seller may issue a prepayment invoice (in full or in part), especially for new customers and/or made-to-order items, regardless of the payment method selected at checkout.

2.3. Payment is possible by bank transfer and, where available, by bank payment cards.

3. Delivery / collection and lead time

3.1. Delivery/collection methods (depending on options available at checkout):
1) courier delivery;
2) parcel locker / pick-up point delivery;
3) collection at the Seller’s office/pick-up location.

3.2. The lead time depends on the product type (in-stock goods vs. made-to-order/personalised production) and is indicated during checkout and/or in the order confirmation. For customised items, the lead time is typically counted from receipt of payment and (where applicable) the Buyer’s artwork/preview approval.

4. Unavailability of goods

4.1. If a product is unavailable (e.g., out of stock at the manufacturer), the Seller will inform the Buyer and, by agreement, will either offer an equivalent product or refund the payment made (if already paid).

5. Right of withdrawal, returns and refunds

5.1. A Consumer may withdraw from the Distance Contract within 14 days:
– from the day the Consumer (or a third party indicated by the Consumer) receives the goods (for goods);
– from the day the contract is concluded (for services).

IMPORTANT — especially relevant to our products!
The 14-day right of withdrawal does NOT apply to goods that are made according to the Consumer’s specifications or are clearly personalised (Cabinet of Ministers Regulation No. 255, Clause 22.3).
This applies to most of our products because they are produced to order (e.g., printing based on customer artwork, stamps, labels with customer layout, engraving, etc.).

5.2. To exercise the right of withdrawal (where applicable), the Consumer must send a written notice to: info@zimoguveikals.lv, indicating the order number, name and contact details. The notice can be submitted in free form or using the withdrawal form.

5.3. Withdrawal form (optional): download.

5.4. After submitting the withdrawal notice, the Consumer must return the goods within 14 days to: Riga, Matisa iela 78A, Latvia. The direct cost of returning the goods is borne by the Consumer unless the Seller states otherwise. The transport risk until the goods are received back by the Seller is borne by the Consumer.

5.5. The Seller shall refund payments received from the Consumer no later than 14 days from the day the Seller is informed about the Consumer’s decision to withdraw; however, the Seller may withhold the refund until the goods are received back or until the Consumer provides evidence of having sent back the goods. Refunds are made using the same payment method used by the Consumer, unless the Consumer expressly agrees otherwise.

5.6. The Consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods (as would be permitted in a shop).

6. Non-conformity / defects and warranty

6.1. The Consumer may submit a claim regarding non-conformity/defects of goods or services within the statutory period (typically up to 2 years, depending on the case and applicable rules).

6.2. If a manufacturer’s warranty applies, it is valid under the manufacturer’s terms. For questions, please contact: info@zimoguveikals.lv.

7. Dispute resolution

7.1. If any issue arises, please contact us first at: info@zimoguveikals.lv. If the dispute cannot be resolved amicably, the Consumer may contact PTAC / the Consumer Dispute Resolution Commission (out-of-court dispute resolution).
